Member Agreement and Share Shop Use Policy
Before you can borrow things, you need to agree to this Share Shop Tiverton’s Member Agreement and Share Shop Use Policy, and to the terms of the Liability Waiver as set out below.
Mission and Ethos
Share Shop Tiverton is run entirely by volunteers. It requires people to follow a few rules so everyone, plus the environment, benefits as much as possible. In order to borrow items you need to become a member and agree to the terms below.
Definitions
The ‘Member’ –
any person who has created a Share Shop Tiverton account, regardless of whether they have borrowed from the Share Shop or not.
‘Item’ or ‘tool’ –
any piece of equipment stocked by the Share Shop Tiverton.
‘Share Shop Tiverton’ (or ‘us’, ‘we’ or ‘our’) –
the organisation lending out items to Members. Share Shop Tiverton is a project of Sustainable Tiverton CIC.
‘Borrowing’ –
the act of picking up, taking care of and making use of an Item from Share Shop Tiverton; and returning it, clean, to the agreed place, at the agreed time.
Joining & Annual Membership
Only Members are able to borrow things from Share Shop Tiverton.
To become a Member, you must:
1. Be aged 18 or over
2. Complete your personal information and date of birth
3. Confirm your email address so that we can contact you
4. Have your residence confirmed and identity verified by a Share Shop Tiverton volunteer.
5. Pay the membership fee.
Your membership will be activated once your residence has been confirmed by a Share Shop Tiverton volunteer and your identity verified. Verification of your identity is accomplished by presenting an official photo ID and a second form of identification that includes your current address, which must be dated within the past three months (eg utility bill).

In addition to the annual Membership Fee there are weekly costs to borrow each item and in some cases (more valuable items) there may be a deposit. There also additional fees if an item is returned late or uncleaned.
Renewing Membership
You can renew your membership before it expires. This can be done online by logging in to your Share Shop Tiverton account. Close to the expiration date of your membership you will receive a reminder with instructions, or you can find more info on how to renew on our website.
Borrowing Items
By taking possession of any item, you are certifying that you are capable of using that item in a safe and proper manner. In becoming a Member of Share Shop Tiverton you are agreeing to relinquish any and all claims against Share Shop Tiverton.
You, the Member, remain responsible for the item while it is in the possession of a designated second person you have registered on your account. The designated second person may pick up or drop off your item for you.
Only you, the Member, are authorized to use Share Shop Tiverton’s things. You shall not permit any other person to use the items you borrow unless by express permission of Share Shop Tiverton.
You agree that Share Shop Tiverton is not responsible for any manufacturing defects in quality of workmanship or materials inherent in any borrowed things. If a tool breaks, becomes unsafe or is malfunctioning, you agree to stop using it. We want our things used lots, but they will eventually break down. We won’t hold you responsible and will organise a replacement if we have one, but you must notify us of the issue on return, if not earlier.
Some things require consumable parts (e.g. sanders have sanding pads, jigsaws have blades, etc). Please note they may not come with the tool. You may have to buy your own blades, sanding pads, etc… If they are provided, please bear in mind that these consumable parts come at a cost, and should you use them, you should either replace them, or donate to cover their cost.
Share Shop Tiverton reserves the right to refuse the loan of any item at its discretion.
Renewing Loans
You can renew items online as long as no one else has reserved the item.
Requesting Items
Items can be reserved online and must be collected from The Eco Hub, Raymond Penny House, Tiverton EX16 6LU during our opening hours.
Returning Items
All things are to be returned in the same (or better) condition as they were issued, barring normal wear and tear.
All things borrowed are to be returned to Share Shop Tiverton by close of business on their due date. Unless otherwise agreed, items may only be returned during Share Shop Tiverton opening hours. Failure to do so may mean a delay in them being checked in and late fees being accumulated. Please try and return your items as early as possible in case someone else is borrowing them on the same day.
All things must be returned clean, and if they are returned dirty, Share Shop Tiverton may charge the member £5 to cover the cost of cleaning if it is required.
If an item is returned late, you will be responsible for a late fee. Please be considerate. Other people may be relying on you to return the items on time. It is better for everyone if items are returned on time without late fees applying. The late fee will be £1 - £5 per day (depending on the value of the item) until the item is returned. All fees are per item, so if you have more than one item, you will be charged a separate late fee for each item. Please note that we have limited opening hours so if you miss your return date you will be charged a late fee per day regardless if we are open or not.
Late fees are capped at the full replacement cost of the items. Share Shop Tiverton may replace items that are severely overdue, holding the Member responsible for the full replacement cost. Late fees must be paid in full before borrowing further items.
You agree to pay for the loss of or damage to any item through misuse, and further agree to accept Share Shop Tiverton’s assessment of the condition of items and further agree to Share Shop Tiverton’s assessment of fair restitution for damage, dirtiness, and/or loss of items in part or in total. This restitution amount could equal the full replacement cost of the item.
Share Shop Tiverton reserves the right to use appropriate steps to retrieve late items or unpaid fines and late fees.
Treatment of Share Shop volunteers
By becoming a member you agree to treat all our volunteers with kindness. Volunteers are asked to follow our polices and procedures and our software will automatically apply our polices on (for example) late fees. If you feel badly treated please email shareshoptiverton@gmail.com and we will contact you to discuss the problem.
IN SHORT
- You borrow the items from Share Shop at your own risk
- Return items clean, on the day they are due back, to the place you picked them up from and during normal opening hours unless otherwise agreed
- Use common sense when using the items you borrow
- And tell us if there is any problem.
And now for the serious bit…
By becoming a Member of Share Shop Tiverton you are affirming that:
- you agree to comply with the Members Agreement and Share Shop Use Policy and know that Items have to be returned clean and on time, otherwise you can be charged the additional fees listed above; also that failing to return an Item may result in revocation of borrowing privileges and loss of any deposit that you have paid;
- the information you provided is current, true, and correct, and you understand that this information might be subject to verification. You will notify us of any change of address during your membership.
- you waive all rights to make any claims against Share Shop Tiverton or Sustainable Tiverton CIC, and you understand you are solely responsible for anything that happens because of Borrowing an Item, even if the Item turns out to be faulty.
- You agree that Share Shop Tiverton may vary the terms of this agreement, including the Liability Waiver below, at any time by giving two weeks’ notice by email to the email address that you have registered with us
Liability waiver
The things in our library are for the use of Share Shop Tiverton members only. Out of respect for other members, please take care of the things you borrow and report any damage to Share Shop Tiverton immediately. To keep you safe, if any borrowed thing becomes unsafe or in a state of disrepair, immediately stop using it. Though members are responsible for damage that they have caused, we promise not to be angry. If you would like to return borrowed things in better condition than when you borrowed them, that would be highly appreciated!
Your Statements (Please read these each time you borrow)
· I am capable and experienced in using the items I am borrowing, and that I will use the items I am borrowing in a safe and proper manner. I am aware that Sustainable Tiverton CIC, its directors, staff, contractors and volunteers claim no expertise and make no representation concerning the fitness of any item for any particular use.
· I, do hereby for myself, on behalf of my heirs, successors, and assigns, in consideration of being permitted to borrow things, waive any and all claims against Sustainable Tiverton CIC, its directors, staff, contractors and volunteers for any injury or injuries of any nature that I may suffer or incur in the use of the item that I am borrowing from Share Shop Tiverton except those caused by a defect known to Share Shop Tiverton and not made known to me.
· I agree to release and indemnify and hold harmless Sustainable Tiverton CIC, its directors, staff, contractors and volunteers from any and all liability, loss, claims, and demands, actions or causes of action for the death or injury to any peoples and for any property damage suffered or incurred by any person, which arises or may arise or be occasioned in any way from the use or possession of things I am borrowing from Share Shop Tiverton.
· I have read and fully understand and agree to the Members Agreement and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges and/or legal action against me.
IN SHORT: I’m responsible for how I use what I borrow, and I won’t blame the Share Shop Tiverton team for what I do with the things.
